CARTA A LAS CABEZAS DE ESTADO DE LA UNION EUROPEA/UNETE AL ESCRITO

Nos mandan esta carta en donde se les pide a las cabezas de estado de la union europea que no den por ganador a Felipe Calderon ya que todavia no ha sido calificado por el Tribunal Electoral, que al felicitar a Calderon se contribuye a crea un ambiente de tension social.

> It is with utmost respect that we, the undersigned, write to you regarding
> the recent Mexican presidential elections. As you must well be aware, Mexico
> is a polarized country, one with historical divisions between social
> classes. This polarization was further augmented during the one-year
> presidential race which culminated in last week’s election.
>
> A preliminary tally suggested a very tight race, with the leading candidates
> separated only by 1.04 %. Numerous reports of inconsistencies during the
> election forced a recount of the sums from some of the electoral booths, an
> action that revealed that the difference between the leading candidates was
> actually less that 0.6 % (Right-wing candidate Felipe Calderón 35.89 % and
> left-wing candidate Andrés Manuel López-Obrador 35.31 %). Such a small
> difference, together with the inconsistencies described, leaves doubts
> regarding the legitimacy of the above mentioned results. Calderon’s claims
> of victory before the legal procedures have finished, have added tension to
> the already tense social scenario. The left-wing party has the right to
> challenge the election and review the process through the Electoral Tribunal
> (Tribunal Electoral del Poder Judicial de la Federación; hereafter Electoral

> The United Nations Committee of Human Rights, in interpretation of the
> International Covenant on Civil and Political Rights has stated that: “there
> should be independent scrutiny of the voting and counting process and access
> to judicial review or other equivalent process so that electors have
> confidence in the security of the ballot and the counting of the votes”.
> According to the Mexican legal system, the only competent authority to
> declare the elected president is the Electoral Tribunal. The Mexican
> Constitution, article 99 II states that this tribunal “will issue the final
> results of the election of the President of the United Mexican States”.
> Moreover, it is only after it resolves “the challenges on the election
> brought to its attention (that) it will proceed to formulate the declaration
> of validity of the election and who is president-elect, who will be the
> candidate who obtained the greatest number of votes”. The Tribunal has not
> yet, and has up to September 6th, to declare its resolution.

> Thus, we appeal to your humanism, democracy and respect for foreign
> countries so that you, as Heads of State, abstain from congratulating any
> candidate until the Electoral Tribunal of Mexico declares a formal elected
> president. Failing to respect the international and Mexican laws and
> regulations in this matter will only increase social tension in Mexico and
> diminish any credibility and legitimacy that either of the candidates may
> have for governing the country.
